Abstract
يتكون هذا الكتاب من فصلين. الفصل الأول يناقش أحكام ثبوت النسب من الأب. يتناول الزواج الصحيح من منظور جمهور الفقهاء ومذهب أبي حنيفة والجعفرية وإبن تيمية. ثم يناقش مدة الحمل في الفقه الإسلامي وفي التشريع الجزائري. المطلب الثالث في هذا الفصل يتناول موضوع اللعان وتعريفه وأركانه وأحكام دعوى اللعان، بالإضافة إلى نفي النسب بالطرق العلمية. يناقش أيضا الزواج الفاسد ونكاح الشبهة وثبوت النسب خلال العدة. الفصل الثاني يحتوي على طرق إثبات النسب القانونية وأحكام إثبات النسب من التلقيح الصناعي والإستنساخ. يختتم الفصل بتعريف اللقيط وأحكام إلتقاطه ونسبه.
Abstract Translated
This book consists of two chapters. The first chapter discusses the rules of proving paternity from the father. It deals with legitimate marriage from the perspective of jurists and the schools of Abu Hanifah, Ja’faris and Ibn Taymiyyah. It then discusses the duration of pregnancy in Islamic jurisprudence and in Algerian legislation. The third section in this chapter deals with the subject of li’an (mutual imprecation), its definition, pillars and the rulings of the li’an (mutual imprecation) lawsuit, in addition to negating paternity by scientific means. It also discusses irregular and doubtful marriages and proving paternity during the ‘iddah/waiting period (the period when widowed or divorced women should not re-marry). The second chapter contains the legal methods of proving paternity and the rulings of proving paternity from artificial insemination and cloning. The chapter concludes with defining foundlings, the rulings of finding the foundling and its paternity.
