يتناول هذا الكتاب موضوع الفحص الطبي قبل الزواج من الناحية الشرعية والقانونية والتطبيقية في فصلين. الفصل الأول يناقش مفهوم ومشروعية الفحص الطبي قبل الزواج. الفصل الأول يتناول أيضا الأمراض المؤثرة في الحياة الزوجية بالإضافة إلى إيجابيات وسلبيات إجراء الفحوصات الطبية قبل الزواج، وأرآء الفقهاء والحكم الشرعي في هذا الموضوع خاصة في حالة زواج الأقارب. الفصل الثاني يناقش الفحص الطبي قبل الزواج من ناحية قانونية ومذاهب العلماء في مشروعية تقنين الفقه الإسلامي. يتضمن هذا الفصل أيضا دراسة ميدانية عن رأي المجتمع الأردني بقانون الإلزام بالفحص الطبي قبل الزواج.
Abstract Translated
This book deals with the subject of premarital screening from a sharia, legal and empirical perspective in two chapters. The first chapter discusses the concept and legitimacy of premarital screening. The first chapter also deals with diseases affecting marital life, in addition to the advantages and disadvantages of premarital screening, and the jurists’ opinion and shariah-based ruling of this subject, especially in consanguineous marriages. The second chapter discusses premarital screening from a legal perspective and the jurists’ doctrine in the legitimacy of coding Islamic jurisprudence. It also consists of a field study on the opinion of Jordanian society on enforcing premarital screening.
