يتناول البحث موضوع السر الطبي في القانون الوضعي مع التركيز على القانونين الكويتي والفرنسي ويتكون من أحد عشر مبحثا: السر والأخلاق؛ تاريخ السر الطبي؛ مفهوم السر الطبي ونطاقه؛ طبيعة السر الطبي وأساس الالتزام فيه؛ الأشخاص الملتزمون بحفظ السر؛ مدى الالتزام بالسر الطبي؛ التبليغ عن حالات الحمل من سفاح؛ شهادة الطبيب أمام القضاء؛ السر الطبي وطبيب العمل؛ العناصر التي يجب أن تتوفر في إفضاء السر؛ وعقوبة إفشاء السر.
Abstract Translated
The article discusses medical confidentiality in positive law with a special focus on the Kuwaiti and French legislation. It consists of eleven main sections under these subtitles: privacy and ethics; history of medical confidentiality; definition and scope of medical confidentiality; nature and foundation of medical confidentiality; persons required to maintain medical confidentiality; extent of maintaining medical confidentiality; reporting cases of extramarital pregnancy; physician’s testimony in court; medical confidentiality and the work physician; elements constituting breach of medical confidentiality; punishment for breaching medical confidentiality..
