Abstract
Islamic jurisprudence and ethics are two normative sciences that have similar opinion on many issues. This article seeks to find a solution for time that these sciences have different opinion. Ethics as a subdivision fo practical wisdom has a prior effect on Islamic juris- prudence's researches as it can change the course of Islamic juris- prudence's deduction to a certain path. The important issue is accurate recognition of repugnance extent, because we can't abandon a religious opinion with regard of every ethical understanding. Rule making and restrictin function are two different roles that ethics can play in the course of deduction and change the result of deduction and opinion of the jurisconsult reach a jurisprudence opinion. In the first function jurisconsult reach a jurisprudence opinion by a ethical understanding and in second function jurisconsult use ethical principle as a exception of religious rule.
