Abstract

The major objective of this paper is to introduce Islamic ethical discourse in the context of Islamic biomedical ethics which up until now has been restricted to judicial decisions issued by Muslim jurists in modern context. The ethical doctrines that undergrid the legal tradition in Islam hold the potential for an inclusive universal language that can engage both the secular and other religious bioethics on several biomedical and biotechnical issues. The paper demonstrates that it is imperative to determine the epistemic parameters of Islamic ethics as it relates to this new field in Muslim cultures. The main thesis of the study is that while judicial decisions (fatawa) can serve as the raw material for understanding religious position taken by Muslim jurists, ethical evaluation of new cases is possible only when moral issues are meticulously expounded to render an ethical decision about a moral quandary.
