Abstract

يستهل الباحث كلامه عن موضوع ضمان الطبيب بالحديث عن كرامة الحياة الإنسانية في الإسلام ثم يناقش المواضع التي يكون فيها الطبيب ضامنا أو غير ضامن للأخطاء الطبية. ويركز الباحث بشكل خاص على الآراء الفقهية للمذهب الجعفري لدى الشيعة الإمامية.

Abstract Translated

This paper starts with elaborating on the concept of human dignity in Islam. Then author discusses the cases in which the physician will be held (non-) liable for medical errors. The author is particularly interested in elaborating the opinions of the Jaʻfarī school within the Shīʻī tradition.
