يتكون هذا الكتاب من ثلاثة أبواب تناقش مسألة زرع الأعضاء من الناحية القانونية والشرعية. ويتكون الباب الأول من أربعة فصول تناقش المواضيع التالية: المشاكل القانونية لنقل وزراعة الأعضاء، والذي يشمل تعريف عملية نقل وزرع الأعضاء، ومراحل ظهور هذه العمليات، بالإضافة إلى رأي الأطباء والتشريعات حول هذا الموضوع، وخاصة التشريع المصري؛ الضوابط اللازمة لإباحة هذه العمليات؛ الجانب الفقهي لعمليات زرع الأعضاء؛ ومشروعية نقل الأعضاء في الشرائع السماوية. اما الباب الثاني فيتكون من فصلين عن الضوابط القانونية لنقل وزراعة الأعضاء بين الأحياء، ومن الأموات إلى الأحياء. ويتكون الباب الثالث من فصلين عن المسؤولية القانونية لدى الطبيب وخاصة في مجال زرع الأعضاء، وموضوع الإتجار بالبشر.
Abstract Translated
This book consists of three sections that discuss the issue of organ transplantation from a legal and jurisprudential perspective. The first section consists of four chapters that discuss the following topics: the legal issues of organ transplantation, which includes the definition of organ transplantation operations, the stages of the emergence of these operations, in addition to the opinions of physicians and legislations on this issue, especially the Egyptian legislation; the necessary regulations for the legalization of these operations; the jurisprudential opinion regarding organ transplantation; and the legitimacy of transferring organs in divine laws. The second section consists of two chapters on the legal regulations for transferring and transplanting organs between the living, and from the dead to the living. The third section consists of two chapters on the legal liability of doctors, especially in the field of organ transplantation, and the subject of human trafficking.
