Abstract

يناقش الكتاب بعض القضايا المعاصرة في الفقه الجنائي الإسلامي. ويتكون الكتاب من أربعة فصول تتناول الموضوعات التالية: الدية بين العقوبة والتعويض، التعويض بين الشريعة والقانون، أحكام وأنواع الدية، تعريف الشبهة، الشبهة وأثرها في إسقاط العقاب، منهج النظام الجنائي الإسلامي في العقاب، امتناع الطبيب عن العلاج بين الشريعة والقانون، والمسؤولية عن السلامة في الطيران المدني من خلال الأنظمة والقوانين المعاصرة.

Abstract Translated

The book discusses some contemporary issues in Islamic criminal jurisprudence. The book consists of four chapters dealing with the following topics: the blood money (the financial compensation paid to the victim or heirs of a victim in the cases of murder) between punishment and compensation; compensation between the Sharia and the law; the rulings and types of blood money; the definition of doubt; doubt and its impact on the removal of punishment; the Islamic penal system of punishment; withholding of treatment by a physician between Sharia and the law; and the responsibility for safety in civil aviation in the contemporary regulations and laws.
