بيع المرأة في مرض موتها لشقيقها

أصدرت هذه الفتوى ردا على سؤال عن إمرأة مريضة مرض الموت، باعت لشقيقها ما تملك من عقار. أجاب الشيخ بأن إذا كان البيع في مرض الموت لغير وارث ومن غير محاباة يكون نافذ. أما إذا كان المشتري وارثا كان البيع موقوف على إجازة الباقين من الورثة. أما إذا كان في البيع محاباة، يكون القدر المباع وصية تنفذ في حدود الثلث.

This fatwa was issued in response to a question asked about a woman with terminal illness, who sold all her properties to her brother. The Sheikh replied that if the sale by the terminally ill was done to a non-inheritor and without bias, is implemented. However, if the buyer was an inheritor, the legitimacy of the sale is dependent on the acceptance of the rest of the inheritors. Additionally, if there was bias in the sale, then the approved sale will be limited to the third of the estate as if it were done by will.
