Abstract

أصدرت هذه الفتوى ردا على سؤال عن شخص أرضع من قبل عمة والده مع بنت العمة الوسطى. أما بنت العمة الكبرى، فرزقت ببنت يريد هذا الرجل التزوج منها، علما بأن عدد رضعاته من عمة والده غير معروفة لوفاتها. أجاب الشيخ أن في المذهب الحنيفي، الرضاع سواء كان كثيرا أم قليل يؤدي إلى تحريم متى تم في مدته. أما في المذهب الشافعي، لابد من إتمام خمسة رضعات في مدته ليؤدي إلى التحريم. وأضاف أيضا أن الزواج في حالة الشك في هذه الحالة مكروها.

Abstract Translated

This fatwa was issued in response to a question about a man who was breastfed by his father’s aunty, with one of her middle daughters. As for the elder daughter, she gave birth to a girl whom the man wants to marry, given that the number of times breastfed by the aunty are unknown given her death. The Sheikh replied that according the Hanafi school of Islamic thought, a small or large amount of breast feeding leads to an 'unmarriageable kin' relationship as long as it was done during the breast feeding period (two years). As for the Shafi’i school of Islamic thought, a minimum number of five breast feedings must be completed in order for it to lead to the 'unmarriageable kin' relationship. He also added that in cases where there is doubt, marriage is disliked (makruh).
