Abstract
أصدرت هذه الفتوى ردا على سؤال عن إمرأة إدعت بأنها وإبنها يرثان في زوجها المتوفي، والد الإبن القاصر الذي تزوجها بدون وثيقة زواج. واعترفت بأنها كانت متزوجة بشخص أخر قبله، وأتضح بأن المدة بين طلاقها من زوجها الأول وبين تاريخ محضر ميلاد القاصر تسعة أشهر وعشرة أيام. فسئل عما إذا كانت تسمع الدعوى من قبل المرأة وإبنها أم لا. أجاب الشيخ بما أن المرأة من ذوات الحيض، وأنها ولدت الإبن وهي متزوجة بالرجل المتوفى والمدة بين الطلاق وميلاد الإبن هي ستة شهور ونصف، تسمع الدعوى. وذلك لأن أقل مدة الحمل هي ستة أشهر ولأنه علم أن زواجها من الزوج الثاني كان بعد أن خرجت من العدة بالحيض. وعلم أيضا بأن الوالد المتوفى قد أقر بنسبه، فلذلك تسمع دعوى الزوجة والإبن.
Abstract Translated
This fatwa was issued in response to a question about a woman who claimed that she and her son have the right to inherit her deceased husband, who is the father of the child and who married her without a marriage contract. She admitted that she was previously married and it was made clear that the period between her divorce from her previous marriage and the birth of her child was nine months and ten days. Therefore the question was whether hers and her son’s claims should be heard or not. The Sheikh replied that given that the woman menstruates, and that she gave birth to the child whilst she was married to her second, now deceased, husband, and that the period between her divorce and the birth of her child was six months and a half, her claim should be heard. This is because the minimum period of pregnancy is six months, and because it became clear that her marriage from the second husband happened after her Iddah (period of waiting) by menstruation ended. It was also acknowledged that the deceased father admitted paternity, and thus the claim of the son and wife should be heard.
