يتكون هذا الكتاب من ثلاثة فصول. الفصل الأول يناقش بيع الأعضاء البشرية والحكم الشرعي من بيع الأعضاء الآدمية وموقف القانون المدني والتشريعات الوضعية في الدول الأجنبية والقوانين العربية من بيع الأعضاء. الفصل الثاني يتحدث عن هبة الأعضاء الآدمية والتمييز بين عقد الهبة وعقد التبرع وعقد المقايضة. ثم يتناول موقف الفقه والقانون من هبة الأعضاء والخطأ الطبي في نقل الأعضاء. الفصل الثالث يتحدث عن موقف التشريعات الوضعية من التوصية بالأعضاء البشرية وتحديد لحظة الموت ومعيار موت القلب والدماغ
Abstract Translated
This book consists of three chapters. The first chapter discusses the sale of human organs, the legal rulings concerning the selling of human organs and the position of civil law in Arab and non-Arab legislation towards selling organs. The second chapter talks about human organ gifting, and differentiating between a gift contract, donation contract and tradeoff contracts. It then deals with the position of jurisprudence and law towards donating organs, and medical errors in transferring organs. The third chapter talks about the position of positive law towards donating human organs in wills, and determination of death and standard of cardiac and brain death.
