هذا الكتاب عبارة عن بحث مقارن يبين حالات الضرورة الشرعية وضوابطها وقواعد الفقهاء فيها في ثمانية مباحث. المبحث الأول يتناول أساس مبدأ التحريم والإباحة ومفهومهم في النظام الشرعي. المبحث الثاني والثالث والرابع يناقشون مقاصد الشريعة، أدلة مشروعية مبدأ الضرورة ومفهوم وضوابط الضرورة. المبحث الخامس يحتوي على حالات الضرورة المختلفة مثل السفر والمرض والنقص الطبي. المبحث السادس يحتوي على قواعد الضرورة وتطبيقاتها، والسابع يناقش أحكام الضرورة وأثر الضرورة في إباحة المحظور. المبحث الثامن والأخير يناقش الضرورة في القانون الوضعي.

This book comprises a comparative study explaining cases involving necessity in sharia and its guidelines as well as relevant juristic rules in eight sections. The first section deals with the basis of the principle of permissibility and impermissibility in the Islamic legal system. The second, third and fourth sections discuss the objectives of Sharia (law), the legitimating proofs of the principle of necessity, and the concept and restrictions of necessity. The fifth section contains the various cases of necessity such as travel, illness and medical shortages. The sixth section contains the rules of necessity and its applications, and the seventh discusses the rulings of necessity and its impact on allowing prohibited items. The eighth and final section discusses necessity in positive law.
