Abstract

يبحث الكتاب موضوع ذوي العاهات العقلية وإرتكابهم الجرائم. يتكون الكتاب من مبحث تمهيدي عن التأصيل الشرعي لذوي العاهات العقلية. يحتوي أيضا على ستة مباحث: يتناول الأول مناط المسؤولية الجنائية في الشريعة الإسلامية. الثاني يتناول مذاهب الفقهاء في إرتكاب ذي العاهة العقلية جريمة موجبة للحد أو القصاص. الثالث والرابع يناقشان مدى ثبوت المسؤولية التأديبية والمدنية في حق ذوي العاهات العقلية . المبحث الأخير يحتوي على دراسة فقهية مقارنة عن الحماية الجنائية والإجتماعية لذوي العاهات العقلية والبدنية.

Abstract Translated

This book discusses the subject of those with mental retardation committing crimes. The book consists of an introductory study on the legitimate shariah-based rooting of those with mental retardation. It also consisits of six studies; the first deals with the focus of criminal responsibility in Islamic law. The second deals with the doctrines of jurists in relation to those with mental retardation committing crimes that lead to punishment or retribution. The third and fourth discuss the extent of which the civil and disciplinary liability is proven on those with mental retardation. The final study is a comparative jurisprudential study of the criminal and social protection for those with mental and physical disabilities.
