يتناول البحث الفرق بين الضرر المادي والضرر الأدبي ومسألة أصحاب الحق في التعويض عن الضرر الأدبي في حالة موت المصاب مع التركيز على القانونين المصري والأردني ويتكون من مبحثين رئيسيين: تاريخ المسألة والحلول القانونية وتطورها؛ و تقدير النظام القانوني لهذا الموضوع واقتراح الحلول المناسبة.
Abstract Translated
The article discusses the distinction between material and immaterial damage and investigates who has the right to request compensation for immaterial damage in case of the death of an injured person with a particular focus on Egyptian and Jordanian laws. It consists of two main sections: history of the question as well has available legal solutions and their development; and assessment of the question by the legal system and suggested solutions.
