Abstract
يتناول البحث موضوع بيع الأعضاء البشرية من وجهة نظر الفقه الإسلامي ويتكون من أربعة مباحث رئيسية: معنى شرط المالية والتقوم عند الفقهاء؛ تطبيقات الفقهاء لهذا الشرط على بيع أجزاء الآدمي؛ مناقشة أقوال الفقهاء في ضوء الإنجازات الطبية المعاصرة؛ في مدى التعارض بين بيع الأعضاء ومبدأ تحريم الإضرار بالجسد.
Abstract Translated
The article discusses sale of human organs from the perspective of Islamic jurisprudence. It consists of four main sections: juristic conditions determining monetary value; juristic applications of these conditions on sale of human parts; discussion of juristic opinions in light of contemporary medical achievements; and extent of conflict between sale of human organs and the principle prohibiting bodily harm.
