يتناول البحث الأحكام الشرعية المتعلقة بالتفريق بين الزوجين للمرض المعدي في الفقه الإسلامي وقانون الأحوال الشخصية الكويتي ويتكون من ثلاثة مباحث: التفريق بين الزوجين لوجود المرض المعدي؛ أثر حدوث المرض بعد العقد على ثبوت الخيار في طلب التفريق؛ قياس المرض المعدي على الأمراض المنصوص عليها وشروط المرض الذي يثبت به خيار التفريق بين الزوجين.

The article discusses the sharia-based rulings pertaining to separation between married couples due to a contagious disease according to Islamic jurisprudence and Kuwaiti personal status law. It consists of three main sections: separation between married couples due to a contagious disease; the impact of a post-contract disease on the use of the right of option to request separation; and analogy of a contagious disease to the referenced diseases (justifying separation) and the conditions of a disease that justify the use of the right of option to request separation.
