يشتمل الكتاب على دراسة مقارنة حول موضوع مسئولية الطبيب والجراح وأسباب الإعفاء منها في القانون المدني والفقه الإسلامي مع التركيز على القانون المصري ويتكون من فصل تمهيدي حول ماهية العمل الطبي ومشروعيته في القانون المدني والفقه الإسلامي بالإضافة إلى ثلاثة أبواب تحت العناوين التالية: مسئولية الطبيب وطبيعتها في القانون المدني والفقه الإسلامي؛ أركان المسئولية الطبية في القانون المدني والفقه الإسلامي؛ وأسباب الإعفاء من المسئولية الطبية واثرها في القانون المدني والفقه الإسلامي.
Abstract Translated
The book comprises a comparative study on the liability of physicians and surgeons according to Islamic law and positive legislation with a particular focus on the Egyptian law. It consists of a preliminary chapter on the nature of the medical work and its legality in both civil law and Islamic jurisprudence and three main chapters: the nature of the liability of a physician in both civil law and Islamic jurisprudence; pillars of medical liability in both civil law and Islamic jurisprudence; and reasons for and implications of absolution from medical liability in both civil law and Islamic jurisprudence.
