تم تقديم هذا البحث إلى الندوة التي عقدتها المنظمة الإسلامية للعلوم الطبية في الكويت حول بعض الممارسات الطبية من منظور إسلامي وذلك خلال الفترة 18-21 ابريل من عام 1987. يناقش المؤلف الأبعاد القانونية لبيع أعضاء الآدمي بالإشارة إلى القوانين المعمول بها في عدد من الدول العربية وخاصة الكويت. كما تعرض المؤلف للأبعاد الأخلاقية لهذه القضية من منظور إسلامي ديني. ويخلص المؤلف إلى القول بأن بيع الأعضاء البشرية لا يمكن السماح به سواء من جانب الأنظمة القانونية المعمول بها في الدول الإسلامية أو من جانب الفقه الإسلامي.

This paper was submitted to the symposium held by the Islamic Organization for Medical Sciences (IOMS) in Kuwait during the period 18-21 April 1987 on some medical practices from an Islamic ethical perspective. The author discusses the legal aspects of selling human organs by referring to the laws in different Arab countries especially Kuwait. He also elaborates on the ethical aspects of this issue from an Islamic religious perspective. The author concludes that selling human organs cannot be permitted either on the basis of legal systems in Muslim countries or of Islamic jurisprudence.
