This paper falls within the section أmarriage and AIDSؤ which was one of the main topics discussed in the symposium held by the Islamic Organization for Medical Sciences (IOMS) in Kuwait during the period 6-8 December 1993 on AIDS and its social problems. The paper argues that if one member of a married couple is infected with AIDS, the other partner will be entitled to request terminating the marital relationship. The main argument here is that AIDS is analogous to the communicable and chronic diseases which were discussed by the early Muslim religious scholars who reached the same conclusion. The paper also includes references to the relevant parts from the codes of personal law enforced in Kuwait and Egypt.
