تم تقديم هذا البحث إلى الندوة التي عقدتها المنظمة الإسلامية للعلوم الطبية حول الإيدز والمشاكل الاجتماعية المتعلقة به في الكويت أثناء الفترة 6-8 ديسمبر من عام 1993.يدرس البحث مدى تأثير الإصابة بالإيدز على العلاقة الزوجية من منظور إسلامي. ويؤيد المؤلف فكرة أن الإيدز يمكن قياسه على الأمراض المعدية التي تعرض لها فقهاء الإسلام السابقون. ومن ثم فإن إصابة أحد الزوجين بالإيدز تعطي الطرف الآخر الحق في طلب إنهاء الزواج. ويناقش البحث أيضا العلاقة بين الإم المصابة بالإيدز والجنين خلال فترة الحمل وبين الأم المرضع ورضيعها.

Abstract Translated

This paper was submitted to the symposium held by the Islamic Organization for Medical Sciences (IOMS) in Kuwait during the period 6-8 December 1993 on AIDS and its social problems. The main focus of this paper is the impact of being infected with AIDS upon the marital relationship from an Islamic perspective. The author argues that AIDS is analogous to the communicable diseases whose juristic rulings were discussed by early Muslim religious scholars. Thus, if one member of a married couple becomes infected with AIDS, the non-infected partner would be entitled to ask for the termination of marriage. The paper also discusses the relation of the woman infected with AIDS to her fetus during pregnancy and of the breast-feeding mother to her baby.
