قدم الفقيه السوري، وهبة الزحيلي، هذا البحث إلى الندوة التي عقدتها المنظمة الإسلامية للعلوم الطبية حول الإيدز والمشاكل الاجتماعية المتعلقة به في الكويت أثناء الفترة 6-8 ديسمبر من عام 1993. طرح الزحيلي فكرة أن مرضى الإيدز، من منظور فقه العقوبات، ينبغي أن يتم تقسيمهم إلى صنفين. الصنف الأول يشمل من أصيبوا بالإيدز جراء ممارسات محرمة وسلوك جنسي منحرف أو إدمان للمخدرات. والصنف الثاني يشمل الضحايا وهم من أصيبوا بالإيدز بسبب نقل الدم وما شابه ذلك. فأصحاب الصف الأول فينبغي أن يلقوا عقابا ملائما لما اقترفوه من جريرة أما أهل الصنف الثاني فلا بد أن يعاملوا بما يستحقوه من الرحمة والعطف.

The Syrian religious scholar, Wahbah al-Zuhayli, submitted this paper to the symposium held by the Islamic Organization for Medical Sciences (IOMS) in Kuwait during the period 6-8 December 1993 on AIDS and its social problems. Al-Zuhayli argues that AIDS patients, from a penal law perspective, should be divided into a) perpetrators who were infected with AIDS because of their illicit and deviating sexual behavior or drug addiction and b) victims who were infected with AIDS because of blood transfusion and the like. The first category should be subject to punishment equal to the enormity of their misdeeds whereas the second category should be handled with mercy and passion.
